ORD RADCLIFFE of the Privy Council in an appeal from Ceylon (R. v. Ramaswamy), 1964, 3 WLR 632 at p. 639)...... "Thus in the 6th Edn. of Sarkar on Evidence, published in 1939 (a significant date, as will appear later), it was stated at p. 246 : The general rule that statements made by an accused to the police during an investigation cannot be proved does not affect the special exception in s. 27. Later he refers to a Privy Council ruling in Kundan Lal v. Musharrafi Begum, 631A 326 in support of the view that...."
RAGHAVA RAO, J., in S. Chokalingam Pillai v. M S S M Ganesha Pillai, 1950, 2 MLJ 605, 606.... "What emerges from the relevant case law on the subject (estoppel and eviction by title paramount) is neatly in Sarkar on Evidence...." LORD WILLIAMS & GHOSE, JJ., quoting from Sarkar's Evidence in Order of Reference to the Full Bench in Prafulla v. R., CWN 733, 736.... "If exhibition of hostile animus were the sole test of declaring a witness adverse the object would be frustrated in many instances. A shrewd and composed witness might by concealing his real sentiments or hostile attitude, give unfavourable evidence, and make statements contrary to what the party calling wished him to say (S C SARKAR on Evidence, 4th Edition at p. 970)".
