RAGHAVA RAO, J., in S. Chokalingam Pillai v. M S S M Ganesha Pillai, 1950, 2 MLJ 605, 606.... "What emerges from the relevant case law on the subject (estoppel and eviction by title paramount) is neatly in Sarkar on Evidence...." LORD WILLIAMS & GHOSE, JJ., quoting from Sarkar's Evidence in Order of Reference to the Full Bench in Prafulla v. R., CWN 733, 736.... "If exhibition of hostile animus were the sole test of declaring a witness adverse the object would be frustrated in many instances.
