DR. ASHOK DHAMIJA - PREVENTION OF CORRPUTION ACT, REPRINT W/S 2007 (With SUPPLEMENT UPDATING THE CASE-LAW AND COMMENTARY UPTO JUNE 2007) is yet another prestigious publication. Being a detailed Commentary with the help of case-law discussion of the Supreme Court and various High Courts on the Prevention of Corruption Act, 1988, Prevention of Corruption Act, 1947, Delhi Special Police Establishment Act, 1946, Criminal Law Amendment Ordinance, 1944, Criminal Law (Amendment) Act, 1952, Anti-Corruption Laws (Amendment) Act, 1964, Anti-Corruption Laws (Amendment) Act, 1967, Jammu & Kashmir Prevention of Corruption Act, 2006 (Smvt), Law relating to Accomplices, Specimen Pre-trap and Post-trap Panchnamas and other useful material related to the subject.
The only way to rid the country of corruption is to hang a few of you on the lamp post”! "No, this is not a quote from any insurgent or terrorist groups. And, yes, this is what in fact a Bench of two Judges of the Supreme Court observed on March 7, 2007, while hearing a corruption related matter, making following further observation meant to be directed at the accused, “The law does not permit us to do it but otherwise we would prefer to hang people like you at the lamp post”.
Was it a sudden outburst of anguish, frustration, pain and disgust with the corrupt system that prevails in the country? Or, was it a plain and simple over-activist approach on the part of the Supreme Court Judges directed at catching the eye-balls? Or else, was it a well-considered opinion seeking changes in the system? Well, the jury is still out. But, as expected, the aforesaid observations evoked sharp reactions from various people, groups and media in all shades of opinions between, and including, the two diametrically opposite views.

Irrespective of whether or not one agrees with what the Supreme Court observed as aforesaid, one cannot but agree - that the situation is really grave, that corruption is one of the most important issues to be taken care of in this country, and that the remedy should not be delayed beyond a limit otherwise there is every likelihood of the country degenerating into a lawless society inspite of there being so many well-intended laws keeping in view the all-pervasive ill-effects of corruption."— FROM THE AUTHOR'S PREFATORY NOTE.

Corruption is a hot topic today. It is one of the greatest challenges before the humanity. It also lies at the root of several other problems facing the humanity. Corruption can perhaps be described as the biggest factor responsible for failure and near-collapse of legal and moral fibre of the nations and societies the world over. It undermines the freedom of an individual, weakens the rights of the people, threatens the very existence of the democratic institutions, and jeopardises the safety and security of the state. Development is perhaps the biggest victim of corruption, having suffered adversely due to its ill-effects. The challenge of corruption can and must be confronted at any cost in as much as a positive outcome in the fight against corruption can have tremendous potential for development and growth of the nation and the people thereby alleviating many of the problems facing them. — The Author
