The genesis of this book can be found in the research undertaken by the author on an article on safe harbor protections provided to intermediaries in December, 2006 in Liability of Intermediaries in India: From Troubled Waters to Safe Harbours, 2 Computer and Telecommunications Law Review 60 [2007] . Through the research the author found a paucity of statutory analysis on the Information Technology Act, 2000. Constrained by this he commenced researching on various provisions of the act with the objective of satisfaction of the author’s intellectual curiosity. The project had no broader ambition, though, along this expedition the body of research, metamorphosed into the product, the reader holds in his hand. Through it the author hopes to fire scholarly debate and dissipate the mist over the Information Technology Act, 2000, which remains years after its enactment.

t has been succinctly stated that, “[t]he chance that a law will achieve its intended purpose improves when it is grounded in an accurate understanding of the phenomena it will regulate.”2 Thus, any commentary on a technology specific statute is obligated, to provide a technical sketch before proceeding to a statutory analysis. With such an objective the commentary attempts a novel method of explaining technical process through process flow diagrams. Though, the book is primarily aimed at audience consisting of legal practitioners and academics it is not limited to them, the analysis is throughout filled with cultural references surrounding computing and will appeal to computer technicians.
The Information Technology Act, 2000, finds it’s genesis in the UNCITRAL Model Law on Electronic Commerce, hence it has several common provisions with countries which have based their municipal statutes on the model law. Each provision of the act has been examined with foreign jurisdictions and a comparative analysis has been attempted wherever possible. The reliance on a plethora of foreign academic texts is explained by the common phenomenon all states are today struggling to regulate, this poses relevant issues and provides answers which are emerging in foreign jurisdictions and are sought to be utilised herein.
